Affiliate marketers do not automatically become sellers, but remain responsible for their marketing activities. Not holding stock, packing orders or collecting payment does not mean they may promote any product or disregard links after publishing them.<\/p>\n
E-Commerce Law No. 122\/2025\/QH15 dated 10 December 2025 separately addresses affiliate service providers in Article 25 and affiliate marketers in Article 26. This avoids assigning every programme operator obligation to each person posting links. [1]<\/p>\n
One person may hold several roles. A shop owner selling their own products while promoting another shop's goods, for example, should classify revenue, contracts and responsibilities for each activity.<\/p>\n
Before joining a campaign, check the seller, product, permitted content and commission tracking method. If promotional materials promise unsupported benefits, request clarification or decline to use them.<\/p>\n
Test links on devices buyers commonly use. A link correct when created may later redirect elsewhere or to another product. Maintaining an inventory of posts and referral codes is therefore useful, especially where older content still receives traffic.<\/p>\n
Personal reviews should accurately describe actual experience, context and limits. Writers should not convert brand-supplied information into claims that they personally verified it.<\/p>\n
Where content is advertising or the publisher benefits from referrals, assess advertising transparency duties. Influencers should pay particular attention to advertising disclosure and information checks under the Advertising Law as amended by Law No. 75\/2025\/QH15 dated 16 June 2025. [2]<\/p>\n
Place information about the affiliate relationship where readers can readily recognise it rather than burying it in a long hashtag list. Disclosure does not make false content lawful, so products and statements still need checking.<\/p>\n
Article 26 of the E-Commerce Law requires affiliate marketers to remove links to unlawful goods or services or upon a competent authority's request. It also requires information for verification and other marketing-related duties. [1]<\/p>\n
An internal process can cover receiving information, identifying campaigns, pausing promotion where needed, removing required content and retaining evidence of action. If a product appears across channels, check posts, videos, pinned comments and link collection pages.<\/p>\n
Agree qualifying order conditions, reconciliation timing, returns treatment, the controlling data source and deadlines for challenging figures. Check whether commission rate changes affect existing orders or only future transactions.<\/p>\n
For example, a campaign may record 200 orders with many later cancelled. Marketers should receive a report explaining the difference rather than only a final payment total. Clear reconciliation data reduces disputes without excessive sharing of buyers' personal information.<\/p>\n
Affiliate income must also be correctly classified for tax. Do not assume every commission has the same withholding rate or uses the tax calculation for goods sales.<\/p>\n
Cash alone is not decisive. Consider the relationship, benefits and purpose and substance of the content. Sponsored products or other benefits also matter.<\/p>\n
Removal is a remedial action, not automatic cancellation of existing responsibility. Retain records, cooperate on complaints and assess correction or compensation duties where grounds exist.<\/p>\n
Use assets with clear usage rights. An image being downloadable or already displayed on a marketplace does not establish permission to copy, edit or use it in advertising.<\/p>\n
